Overview

The proposed works were the demolition of the existing conservatory and the construction of a new single storey extension and orangery to the rear of the property.

After reviewing the initial drawings, it was determined that the works were not notifiable under the Party Wall etc. Act 1996 as the excavations were not going down deeper than the Adjoining Owners’ existing foundations. However, once this was explained to all parties, they decided it would be in everyone’s best interests to still have a Schedule of Condition carried out of the Adjoining Owners’ property due to the close proximity of the works.

A Schedule of Condition although not a requirement under the Act, is always a good idea. It safeguards both owners and can act as a line in the sand if there are disputes of damage which arise during or after works are complete.
