Licence To Alter

Overview

The leaseholder proposed to reconfigure the bathroom and ensuite to incorporate a shower, replacing the bathtub. This involved the removal of internal partitions. Although non-structural in nature, the Lease prohibited any internal non-structural alterations.

EK Licence to Alter were appointed to produce a report based on the relevant Lease clauses. Despite this non-structural work being contrary to the lease terms, the freeholder allowed it with certain conditions. As a result, we recommended that the leaseholder install a waterproofing system to all wet areas to ensure adequate protection is in place should a leak occurred; this would protect the freeholder as well as owners of the apartments below.

Prior to works commencing on site, we obtained all relevant and required documents and issued a Pre-Commencement Certificate once the leaseholder had provided all necessary documents to allow consent to be given and works to proceed.

We undertook monitoring inspections to witness the removal of the non-structural partitions and that the waterproofing system was sufficient and installed correctly.

Following the works we conducted a final inspection to ensure all works were complete and no damage was caused to the common parts or neighbouring properties as a result of the works. Once satisfied, we asked the leaseholder to obtain the relevant completion documents and issued our Completion Certificate.
