Overview

Although the works were not notifiable under the Act, all owners that could be directly affected by the works chose to have a Schedule of Condition due to the close proximity of the works.

Depending on the works being carried out, even if they are not notifiable under the Act, it can still be extremely beneficial to still have a Schedule of Condition as it can safeguards both owners and can act as a line in the sand if there are disputes of damage which arise during or after works are complete.
